Redundancy & Re-Employment  

When making redundancies, don’t forget the search for alternative employment. It’s a key part of a fair process and the duty continues right up to the end of notice.

If a suitable alternative role comes up:

- Offer it formally, with clear detail on the job, terms and start date.
- Make sure the offer comes before the termination date.
- If the employee unreasonably refuses it, they may lose their right to a redundancy payment.

If a new job starts immediately (or within four weeks), a statutory trial period kicks in. If it goes well, employment continues. If not, redundancy may still apply but only if the refusal or resignation is reasonable.

And what if a new opportunity comes up after termination? You can still rehire, but you’ll need to consider the risks:

- Continuity of employment may reset, unless there’s less than a one-week break.
- Redundancy repayment isn’t required, but service starts from scratch.
- HRMC scrutiny can follow if the rehire looks too convenient.
- New role, same duties? You may face a challenge from the ex-employee if the redundancy wasn’t genuine.

As always, timing and communication are key.

Legal Roundup: Guaranteed Hours

A new right to request guaranteed hours is on the horizon, aimed at zero and low-hours workers. It’s not law yet, and we’re unlikely to see anything before 2026, but it’s one to watch.

The idea? If someone has worked regular hours over a set period (likely 12 weeks), you may need to offer them a contract that reflects those hours. They don’t have to accept, but you’ll have to offer.

Agency workers may be covered too, and there are signs that unionised employers could opt out through collective agreements.

What now?

- If you don’t use zero or low-hours contracts, you can breathe easy.
- If you do, it’s worth reviewing how you manage hours and whether a move to guaranteed contracts would make life easier in the long run.
